{"id":4385,"date":"2019-11-13T18:59:20","date_gmt":"2019-11-13T18:59:20","guid":{"rendered":"https:\/\/ourlandourbusiness.org\/?p=4385"},"modified":"2019-11-13T19:04:57","modified_gmt":"2019-11-13T19:04:57","slug":"ukraine-the-land-of-quid-pro-quos","status":"publish","type":"post","link":"https:\/\/ourlandourbusiness.org\/es\/ukraine-the-land-of-quid-pro-quos\/","title":{"rendered":"Ukraine, the Land of Quid Pro Quos"},"content":{"rendered":"<div class=\"l-subsection\"><div class=\"l-subsection-h\"><div class=\"l-subsection-hh g-html i-cf\"><p>By Frederic Mousseau and Elena Teare<\/p>\n<p>The withholding of <a href=\"https:\/\/www.reuters.com\/article\/us-usa-trump-whistleblower\/white-house-acknowledges-strings-attached-in-trump-withholding-ukraine-aid-idUSKBN1WW1BG\" target=\"_blank\" rel=\"noreferrer noopener\">US$391 million<\/a> in military aid to force the Ukrainian government to investigate the business dealings of political rival Joe Biden\u2019s son has triggered an impeachment inquiry against President Trump.<\/p>\n<p>But if we are concerned about foreign aid being used to undermine our democracy, we should also be wary of other quid pro quos taking place in the Eastern European country, which have so far drawn little attention and concern in the West.<\/p>\n<p>In spring 2014, after signing an Association Agreement with the European Union (EU), <a href=\"https:\/\/www.oaklandinstitute.org\/sites\/oaklandinstitute.org\/files\/OurBiz_Brief_Ukraine.pdf\">Ukraine had to commit<\/a> to a set of&nbsp;<a href=\"https:\/\/www.imf.org\/external\/pubs\/ft\/survey\/so\/2014\/NEW043014A.htm\" target=\"_blank\" rel=\"noreferrer noopener\">austerity measures<\/a>&nbsp;in return for a US$17 billion bailout from the International Monetary Fund (IMF). These measures included slashing public pensions and wages, reforming the public provision of water and energy\u2014involving an increase in energy costs for users\u2014privatization of banks, changing the country\u2019s VAT system, and more.<\/p>\n<blockquote class=\"pull-left\">\n<p>The World Bank and the European Bank for Reconstruction and Development (EBRD) have been aggressively&nbsp;laying the groundwork&nbsp;for the large-scale privatization of land and the expansion of industrial agriculture in Ukraine for the past five years.<\/p>\n<\/blockquote>\n<p>One of the most critical measures asked of Ukraine, however, was to end the 18-year old moratorium on the sale of land. Much is at stake for a country known for its rich black soil, with <a href=\"https:\/\/ukraineinvest.com\/sectors\/agribusiness\/\" target=\"_blank\" rel=\"noreferrer noopener\">32 million hectares<\/a> of fertile land \u2013 equivalent to one-third of all arable land in the European Union\u2014and is the world\u2019s leading exporter of <a href=\"https:\/\/www.apk-inform.com\/en\/exclusive\/topic\/1109106\" target=\"_blank\" rel=\"noreferrer noopener\">sunflower oil<\/a> and <a href=\"http:\/\/www.worldstopexports.com\/wheat-exports-country\/\" target=\"_blank\" rel=\"noreferrer noopener\">sixth-largest exporter<\/a> of wheat.<\/p>\n<p>The World Bank and the European Bank for Reconstruction and Development (EBRD) have been aggressively <a href=\"https:\/\/www.aljazeera.com\/indepth\/opinion\/2014\/07\/ukraine-imf-agriculture-2014731945562212.html\" target=\"_blank\" rel=\"noreferrer noopener\">laying the groundwork<\/a>&nbsp;for the large-scale privatization of land and the expansion of industrial agriculture in Ukraine for the past five years.&nbsp;The EBRD, Ukraine\u2019s <a href=\"https:\/\/www.kyivpost.com\/business\/ukraines-biggest-investor-gets-new-leader-in-kyiv.html\" target=\"_blank\" rel=\"noreferrer noopener\">largest<\/a> international investor, has <a href=\"https:\/\/www.ebrd.com\/news\/2017\/ebrd-in-25-million-loan-for-biogas-plant-at-ukraines-mhp.html\" target=\"_blank\" rel=\"noreferrer noopener\">poured millions<\/a> into <a href=\"https:\/\/inventure.com.ua\/en\/analytics\/articles\/the-largest-agriculture-companies-in-ukraine\" target=\"_blank\" rel=\"noreferrer noopener\">supporting<\/a> the country\u2019s leading agribusinesses while <a href=\"https:\/\/www.ebrd.com\/news\/2017\/ebrd-president-urges-ukraine-to-continue-reforms-.html\" target=\"_blank\" rel=\"noreferrer noopener\">pressuring<\/a> the government for land reform to <a href=\"https:\/\/www.reuters.com\/article\/us-ukraine-ebrd-reform-idUSKBN19S1IX\" target=\"_blank\" rel=\"noreferrer noopener\">increase<\/a> private investment. In August 2019, the World Bank <a href=\"https:\/\/www.ukrinform.net\/rubric-economy\/2708725-world-bank-gives-ukraine-a-200-mln-loan-for-agricultural-development.html\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a> a US$200 million loan for the restructuring of the agricultural market and the auctioning of state lands. The announcement of the loan <a href=\"https:\/\/www.kyivpost.com\/ukraine-politics\/world-bank-president-zelensky-reiterates-intention-to-carry-out-land-reform.html\" target=\"_blank\" rel=\"noreferrer noopener\">was accompanied<\/a> by President Zelensky\u2019s pledge to move fast on lifting the moratorium.<\/p>\n<p>Adding to the pressure was an unexpected actor. In August 2018, the European Court for Human Rights (ECHR) <a href=\"https:\/\/hudoc.echr.coe.int\/eng#%7B%22itemid%22:%5B%22001-183128%22%5D%7D\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that the moratorium violated the right to the protection of property under the &nbsp;European Convention on Human Rights. The ruling acknowledged that while Ukrainians can lease their land, being able to sell and <a href=\"https:\/\/hudoc.echr.coe.int\/eng#%7B%22itemid%22:%5B%22001-183128%22%5D%7D\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cdispose of property [is] an essential element of ownership.\u201d<\/a> The court further recognized that while the conceived basis for the moratorium was in the public interest, ultimately, the balance between those interests and individual property rights is not met through the policy. Although the ECHR can only issue rulings and recommendations to countries and <a href=\"https:\/\/www.politico.eu\/article\/human-rights-court-ilgar-mammadov-azerbaijan-struggles-to-lay-down-the-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">has no real enforcement mechanism<\/a>, it enjoys real power in Ukraine where<a href=\"https:\/\/zakon.rada.gov.ua\/rada\/show\/en\/3477-15\/sp:max25\" target=\"_blank\" rel=\"noreferrer noopener\"> the national legislation<\/a> requires the state to implement its rulings.<\/p>\n<p>Now the creation of a \u2018land market\u2019 appears to be moving swiftly: On September 2, President Zelensky <a href=\"https:\/\/www.president.gov.ua\/en\/news\/prezident-doruchiv-vnesti-protyagom-dvoh-tizhniv-do-parlamen-57101\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> his government to draft a bill for the privatization of the agricultural land market, end the moratorium, and be open for business by <a href=\"https:\/\/eng.uatv.ua\/honcharuk-land-reform-expected-place-october-1-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">October 1, 2020<\/a>.<\/p>\n<p>A draft of the bill <a href=\"http:\/\/w1.c1.rada.gov.ua\/pls\/zweb2\/webproc4_1?pf3511=66970\" target=\"_blank\" rel=\"noreferrer noopener\">was released<\/a> on October 1, 2019. However, the bill\u2019s language does little to assuage concerns over privatization, namely land concentration by <a href=\"https:\/\/wtop.com\/europe\/2019\/10\/ukraines-plan-to-sell-farmland-raises-fears-of-foreigners\/\" target=\"_blank\" rel=\"noreferrer noopener\">powerful interests<\/a>. Total land ownership is capped at 15 percent of an oblast (region) and 0.5 percent of the national territory. Although the draft stated that only Ukrainian citizens and companies could own land, there are <a href=\"https:\/\/agrilands.in.ua\/opinion-land-restrictions-are-easy-to-get-around\/\" target=\"_blank\" rel=\"noreferrer noopener\">no safeguards<\/a> against foreign companies <a href=\"https:\/\/rpr.org.ua\/en\/news\/what-is-wrong-with-the-land-market-draft-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">controlling shares<\/a> of Ukrainian companies or concentrating land through multiple firms. Furthermore, as it stands, the bill allows direct ownership for foreign-owned companies operating in the country for more than three years.<\/p>\n<p>In response, there have been a <a href=\"http:\/\/uacouncil.org\/en\/post\/farmers-and-villagers-demanded-a-referendum-on-the-land-market-near-the-verkhovna-rada-of-ukraine\" target=\"_blank\" rel=\"noreferrer noopener\">series of protests<\/a> <a href=\"http:\/\/uacouncil.org\/en\/post\/near-the-parliament-agrarians-and-farmers-demanded-not-to-sell-land-to-oligarchs\" target=\"_blank\" rel=\"noreferrer noopener\">against the bill<\/a>, and public opinion towards land reform is overwhelmingly negative. A <a href=\"http:\/\/ratinggroup.ua\/en\/research\/ukraine\/otnoshenie_ukraincev_k_vnedreniyu_prodazhi_zemli.html\" target=\"_blank\" rel=\"noreferrer noopener\">recent survey<\/a> showed that 73 percent of respondents opposed the lifting of the moratorium, and 81 percent against land sales to foreigners. In response to civil unrest, the government delayed the finalization of the bill and announced <a href=\"https:\/\/www.president.gov.ua\/en\/news\/volodimir-zelenskij-obgovoriv-z-agrariyami-vprovadzhennya-ze-57669\" target=\"_blank\" rel=\"noreferrer noopener\">consultations with relevant stakeholders<\/a>. But outside pressure continues to mount as the country negotiates a new, three-year US$5billion loan from the IMF, which <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-09-14\/ukraine-poised-to-seal-three-year-imf-loan-of-about-5-billion\" target=\"_blank\" rel=\"noreferrer noopener\">appears<\/a> to be again conditioned to the country moving forward on the land reform agenda.<\/p>\n<p>Public fears of Ukraine\u2019s most productive agricultural lands being handed over to global agribusinesses are well-founded. As <a href=\"https:\/\/www.oaklandinstitute.org\/sites\/oaklandinstitute.org\/files\/Brief_CorporateTakeoverofUkraine_0.pdf\">previously reported<\/a> by the Oakland Institute, portions of these lands are <a href=\"https:\/\/www.largescaleagriculture.com\/home\/news-details\/top-10-ukraines-largest-agricultural-landholders-2018\/\" target=\"_blank\" rel=\"noreferrer noopener\">already concentrated<\/a> in the hands of powerful oligarchs and Western agribusinesses. Who precisely controls Ukrainian land has long eluded researchers, as <a href=\"https:\/\/commons.com.ua\/uk\/ofshorizaciya-ukrayinskoyi-ekonomiki\/\" target=\"_blank\" rel=\"noreferrer noopener\">off-shore tax havens<\/a> and land tenure practices make it difficult to discern. In 2015, the Oakland Institute <a href=\"https:\/\/www.oaklandinstitute.org\/blog\/who-owns-agricultural-land-ukraine\">estimated<\/a> that foreign companies could command as much as 2.2 million hectares, and in 2018, the <a href=\"https:\/\/longreads.tni.org\/offshoring-prosperity-ukraine\/#section1\" target=\"_blank\" rel=\"noreferrer noopener\">top 10<\/a> foreign and domestic agro-holdings controlled approximately 2.8 million hectares.<\/p>\n<p>The trend has continued as <a href=\"https:\/\/www.cargill.com\/story\/new-port-project-in-ukraine-will-benefit-farmers\" target=\"_blank\" rel=\"noreferrer noopener\">Cargill<\/a>, <a href=\"http:\/\/www.bayer.ua\/media\/news\/bayer-opens-current-factory-from-seed-production-in-ukraine.php\" target=\"_blank\" rel=\"noreferrer noopener\">Bayer<\/a>, and <a href=\"https:\/\/open4business.com.ua\/dupont-pioneer-launches-sunflower-seed-production-line-poltava-region\/\" target=\"_blank\" rel=\"noreferrer noopener\">DuPont<\/a> have all made hefty investments over the past few years. In July 2019, Ukraine announced that it <a href=\"https:\/\/www.kyivpost.com\/business\/ukraine-to-raise-250-million-euro-from-cargill-at-5-15-6-25-percent.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cattracted\u201d<\/a> two loans from Cargill Financial Services International for \u20ac100 million (US$112 million). In August 2019, Bayer (the group that now owns Monsanto), won an <a href=\"http:\/\/ukrainianlawfirms.com\/asters-defended-interests-of-bayer-ukraine\/\" target=\"_blank\" rel=\"noreferrer noopener\">anti-monopoly suit<\/a> in Ukraine\u2019s Antimonopoly Committee \u2013 an antitrust body that <a href=\"https:\/\/www.unian.info\/economics\/10325766-saudi-agricultural-and-livestock-investment-company-closes-deal-with-mriya-agro-holding.html\" target=\"_blank\" rel=\"noreferrer noopener\">already approved<\/a> consolidation in the <a href=\"https:\/\/en.interfax.com.ua\/news\/economic\/63913.html\" target=\"_blank\" rel=\"noreferrer noopener\">agribusiness sector<\/a>, <a href=\"https:\/\/112.international\/article\/whip-or-carrot-in-whose-interests-antimonopoly-committee-of-ukraine-acts-40642.html\" target=\"_blank\" rel=\"noreferrer noopener\">prompting questions<\/a> regarding its consistency in applying antitrust laws.&nbsp;<\/p>\n<p>Under President Zelensky, Ukraine seems to be catering to the Western interest in the take-over of its agricultural sector. A five-year national plan to <a href=\"http:\/\/documents.worldbank.org\/curated\/en\/903491559008866876\/pdf\/Ukraine-Accelerating-Private-Investment-in-Agriculture-Program-Project.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cmobilize private investment in the agriculture and agribusiness sectors\u201d<\/a> was launched in 2019 with a budget of US$1.2 billion,&nbsp; partly funded by the World Bank loan. Under the Bank\u2019s program, Ukraine will also endeavor to deregulate fertilizers by adopting the EU\u2019s fertilizer list and exempting it from mandatory state registration. The claim is that the \u201cfull harmonization\u201d of Ukraine to EU standards would increase crop output and profits. In August 2019, The Ministry of Economic Development and Trade and the Ministry of Agrarian Policy and Food were put under <a href=\"https:\/\/latifundist.com\/en\/novosti\/45981-milovanov-obyasnil-prichiny-obedineniya-minagroproda-i-mert\" target=\"_blank\" rel=\"noreferrer noopener\">one<\/a> cabinet position\u2014The Minister of Economic Development, Trade, and Agriculture. This move was allegedly meant to counter the&nbsp;notorious <a href=\"https:\/\/www.kyivpost.com\/business\/ukraines-new-economy-minister-addresses-business-community-in-washington.html\" target=\"_blank\" rel=\"noreferrer noopener\">corruption<\/a>&nbsp;of the agricultural ministry and <a href=\"https:\/\/www.ukrinform.net\/rubric-economy\/2770316-newly-appointed-minister-explains-purpose-of-uniting-economy-ministry-with-agrarian-policy-ministry.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201caccelerate the implementation of key reforms.\u201d<\/a><\/p>\n<p>Although conditionalities accompanying Western foreign assistance is a common practice, the way Ukraine is forced to privatize its land and create a land market has no precedent in modern history. It remains unclear how Ukrainians, including the seven million local farmers, will benefit from such privatization. The experience of structural adjustment programs around the world forebode that the reform programs will increase foreign corporate control of the Ukrainian economy while increasing poverty and inequality in the country.<\/p>\n<p>Conditioning US$391 million of foreign aid to his political gain, president Trump\u2019s Ukraine scandal has rightly prompted outrage in the US and around the world.
